i've already mentioned that i don't like betras BUT he just posted this video about the omnibus pretrial motion for relief Dickey filled in PA three days ago, in which he signed a petition for habeas corpus (unlawful detention), and a motion to suppress evidence. i don't know how he gained access to it but there's some interesting stuff, the entire thing is too long so he gave highlights for the first part of it and he hasn't uploaded part two yet.
- as luigi was sitting at a corner table, two cops approached him and posted themselves within arm's length of luigi to avoid him from leaving. they did not tell him why they were approaching him and that he could leave. their only reasoning was that he looked suspicious and had overstayed his welcome at mcdonald's, even though he had been there for less than 30 minutes.
- the two cops immediately began giving him instructions and demands, making him place his hands on top of his head and other stuff prior to them reading him his miranda rights, and when the request for identification was made, they needed luigi's compliance he states that he was being unlawfully detained. still, they proceeded to interrogate him.
- he never showed any threatening gesture or show of force, other than a cop commanding him to stand up to terry frisk him (fuark imagine patting him down, i can only dream) even if nothing justified it.
- it seems like they took possession and control of Luigi's stuff illegally and retained it to do a background check and to see if there was possible criminal activity. at that point, one of the two cops walks outside mcdonald's while in possession of Luigi's stuff to obviously check what the fuck was inside his backpack, while the other cop continued to block Luigi's route and movement.
- they continued to interrogate him, and within minutes, almost 10 pigs came uniformed and in plain clothes, including people from the AG's office. they asked him if the backpack, plastic bag, and other items he had belonged to him.
- they seized the items and packages he had, placed them behind the human wall they built around him to prevent him from leaving and seeing what the fuck was going on, violating the 4th amendment, 14th amendment, and article 1 section 8 of the PA constitution.
